These Terms and Conditions apply to all transactions made with Wholesale Landscapes. This includes orders placed online or by email, phone, fax, post or by any other means. Wholesale Landscapes reserves the right to change these Terms and Conditions at any time.

2. Disclaimer

Because of Photographs techniques, pictures pf [products (including colour) may vary from actual product purchased. Buyers and Users must make their own assessment of our products under their own conditions for their own uses. Because the products we market are natural products -they will change due to weathering, seasons and different seams in the quarry. Wholesale Landscapes will do their up most to ensure your products are consistent - but there are times when this is out of Wholesale Landscapes control. We advise to view product before purchase. 3. Conditions of All Deliveries

TITLE: The title and property does not pass in either the goods or proceeds from the sale or otherwise of the goods to a third party until paid in full.
CONDITIONS: When material is to be delivered in places other than on paved or metaled streets, the customer is to provide roadways or approaches permitting access of trucks to point of delivery under their own power. The seller reserves the right to stop deliveries in the event that such roadways are not provided. If the customer orders deliveries beyond the kerbing, the customer assumes all liability for damage to kerbs, footpaths, driveways or other property, and shall be liable for all cost incurred in removing the truck from the site.
DISCLAIMER OF LIABILITY: As media and landscaping products, including composts are made from batch to batch, strict control cannot be exercised over all the conditions including some fertilizer response, weather, plant & property management. Before during & after any use. No responsibility will be excepted by Wholesale Landscapes under any circumstances to any failure in performance, loss, damage or injury whether direct or indirect or consequential arising from storage handling, mixing or use of these products, and the purchaser shall bear sole responsibility for the correct selection, use and application of this product and acknowledges that the purchaser is buying this product in reliance on the purchasers skill or judgment and not that of Wholesale Landscapes.
 

In the event of a failed delivery (when a delivery vehicle arrives to site and can’t unload) due to unsuitable delivery areas or conditions, Wholesale Landscapes reserves the right to charge the customer for the time and distance of travel. Back to top

4. Privacy Policy

We respect your privacy. We collect this information in order to be able to process your order and to make it easier for you when you re-order. All information about you will be maintained with strict confidence. Should you ever wish your details to be removed from our database, email your request to sales@wholesalelandscapes.co.nz. 5. Visitors

All visitors to any site operated by Wholesale Landscapes must report to the site office for induction to onsite hazards. Safety hat, high visibility vest and appropriate clothing must be worn when around machinery. All visitors must be accompanied by a member of the staff at all times. Back to top

6. Returns

Due to the delivery nature of the services we supply, We will not be obliged to refund any payment  you make to us or exchange any products or services we supply, except what is required by law.
If you have been incorrectly supplied a product at the fault of Wholesale Landscapes, we will cover all costs related to returning the incorrect product to us and supplying you with the correct product. If you wish to return product due to ordering incorrectly or for any other reason other than at the fault of Wholesale Landscapes, all collection costs must be met by you. Back to top
 

7. Delivery Guarantee

We aim to have your delivery to you on time & in full.

In the rare occurrence of a truck breaking down or running late, we will contact you to inform you of the situation and put a plan in place. We aim with all our business operations and valuable customers to treat you, fair, just & with the highest respect. Back to top

Booking ahead for a time delivery is advisable, however we accept “same day delivery’s in the Nelson Region” and will work together to slot in a suitable time.

 

8. Quotations

All written quotations are valid for the amount of days the quotation states, otherwise is 60 days from date quoted.

9. Payments

You agree to pay for all products & service that your order upon Wholesale Landscapes completing your order, and receiving the invoice. You agree that any collection debt cost occurred will be met by yourself. Back to top

10. Cancellations

If you place an order, then cancel when the order has already been dispatched. We will refund your monies minus a $60 Operations Fee. Back to top

11. Hours

Unless otherwise agreed between parties, we will supply the Goods and/or perform the Services in the normal working hours. Any cost attributable to us being required by the customer to work outside these hours shall be payables by the customer.

12. Delivery

The delivery truck sizes are governed by the load size, load type and dispatch sequences. You must ensure that you have sufficient access for the vehicle before placing an order.
Your chosen ideal drop off area should be a flat and even surface near the area you want to lay the product.
Deliveries are made using large vehicles and it is the customer's responsibility to inform the company if there may be an access problem.
Where we are to deliver the Goods, the Customer must:
(a)  Ensure we have all-weather encumbrance free access to the site, to enable us to deliver the Goods safely;
(b)  Obtain all necessary resource and other consents from the relevant local authority and inform us of all matters relating to such consents;
(c) Locate, mark and advise us of all gas pipes, water pipes, sewerage lines, septic tanks, drainage lines, telephone cabling and other utilities that are on, or near, or adjacent to the delivery point, and of any actual or possible subsidence, slip, erosion, flooding or any other thing that might constitute a hazard on the land where Goods are to be delivered;
(d) The customer, or somebody appointed by the customer, must be at the delivery point to accept the delivery or customer explained in detail and left a marker for where product load is to be dumped.
If a certain method of delivery vehicle is required it is the customer’s responsibility to inform the company of these special requirements.
The company reserves the right to cancel or hold any orders that the company deems may suffer from potential delivery problems and the customer understands that delivery dates may be delayed in these instances.
The customer will clearly advise in writing the place where the goods are to be delivered and acknowledges that the site is accessible for delivery. There will be no liability whatsoever on the vendor or its subcontractors for any damage which may be caused in the course of delivery and unloading onsite.
The company’s deliveries are generally gate to gate or kerb side deliveries. The driver will attempt to deliver to the requested location whenever possible, but in the instance where the driver thinks this location is hazardous or inaccessible or likely get stuck, then the nearest possible area to the requested position will be used, the customer also understands that the company can only guarantee a gate to gate or kerbside delivery and that ultimately the customer is happy for goods to be left kerbside.
The Customer shall pay all freight and cartage charges including any additional costs or expenses incurred by us (including charges for waiting time or delivery outside of normal business hours).
The company will not accept any liability for damages to property caused during delivery.
The customer indemnify Us against any costs, claims and damages incurred in the delivery of the Goods including any cleaning, repairing damage to the site or delivery equipment and returning the delivery vehicle to the road, provided we have acted with reasonable care and skill.
The Customer must make any claims for short delivery within 48 hours of delivery of Goods by Us, and must state the date of delivery of the Goods and the delivery docket number. Back to top

13. Late Deliveries

The company will make every effort to deliver products ordered on the agreed date, but, if for any reason the company is unable to deliver then no liability will fall to the company; whether in damages or otherwise, for delay of whole or any part of the goods ordered arising from any cause whatsoever. Back to top

14. Limitations of Our Products & Services

We will take all reasonable care to ensure that our Products & Services are fit for the purpose for which they have been designed, but we are not responsible for factors and circumstances beyond our control.
If products are out of stock then the company also reserves the right to cancel or hold orders for reasons beyond our control.
Any Products/Service that you purchase is generated only at your request and solely on the basis of information you provide to us. You agree that:
(a) Any information we provide to you is information only, and not advice. 
(b) We are not responsible for checking the accuracy, relevance, or significance of any information you provide to us.
(c) You will ensure that the information you provide is complete, accurate, and up-to-date. If you are uncertain about what information to provide in response to our questions, you will seek appropriate advice from a third party of your choice.
(d) You will provide us with your full and accurate contact details and you will keep those contact details up to date. Back to top

15. Product Variances

Colour, texture, size, content, individual rocks, stones, barks, shells & soil types made be broken or misshaped variations may occur in Goods due to:
(a)   The use of naturally occurring materials in the manufacturing process; and
(b)    Normal manufacturing tolerances and processes.
Such variations do not constitute a product defect and we shall not be liable for any loss or damage suffered by you as a result of such variations.
The sizes of products specified are approximate and can vary.
Due to the products we market are natural products – they will change due to weathering, seasons and different seams in the quarry. 16. Copyright Information

All copyright, trade marks and other intellectual property rights subsisting in or used in connection with the Products & Services and the Website are and will remain our sole property.
When you purchase a Product or Service from us, you may download and copy documents provided to you as part of that service providing that you:
(a) only use those documents for the single, specific transaction for which you purchased the Product and/or Service ; and
(b) only make copies of those documents for purposes relating to that transaction; and
(c) do not otherwise copy, reproduce, publish, modify, make an adaptation of those documents in any way.
You may not remove our trade marks, copyright symbols, or any other statement or device which asserts our intellectual property rights from any materials you download from the Website, or from any authorised copies you make of them.
You may not copy, modify, or otherwise interfere with any part of the Website.

23. Hazardous Materials Warning

Soils, Mulches, Composts and Potting Mixes manufactured by Wholesale Landscapes could contain micro-organisms including bacteria, fungi and protozoa. When handling, avoid breathing dust or mists and wear a particulate mask if dusty. Wear gloves and keep moist when handling. Wash hands immediately after use.

Viticulture promotion

 

  1. Minimum delivery volume of 70m3. (2x truck and trailers)
  2. Offer is retricted to greenwaste compost product.
  3. Strictly limited to Kaituna, Renwick and Rapaura areas. All other areas priced on a case by case basis.
  4. Subject to suitable access for full truck and trailer unit.
  5. Price excludes GST.

  7. Price per vine is based on 2.8m rows, 1M vine spacing at applied at 50mm thickness.

  • ENTRY QUALIFIES AS ACCEPTANCE OF THESE TERMS AND CONDITIONS:

    1.    PROMOTER: The Promoter is Wholesale Landscapes.

    2.    ELIGIBILITY: The competition is open to anyone who would like to show the promoter their garden and landscape images to be used in marketing material. All entries must be submitted by 1st July at noon.

    3.    HOW TO ENTER: To submit a photo for entry in the competition, you must email your photo(s) with a description to marketing@wholesalelandscapes.co.nz or comment on the post on the Facebook page of Wholesale Landscapes. Please use Photo Competition in the subject line. Multiple entries may be made.
    4.    PHOTO REQUIREMENTS: The photo(s) must meet reasonable standards of decency. Wholesale Landscapes has the sole discretion to determine whether or not a photo meets these requirements. A description must be included in the email, and all photos must be either JPG or PNG format. 

    5.    HOW TO WIN: The winners will be determined by the Wholesale Landscapes team.

    6.    PHOTO WINNER NOTIFICATION: The photo winners will be announced on an ongoing basis. Each winner will be notified after the decision as has been finalised.  

    8..    ANNOUNCEMENTS: By submitting a photo for entry and, each entrant hereby agrees to participate in any publicity related to the competition. Winners also agree to have his/her image used for publicity purposes without any additional payment being made.

    9.    PHOTO USAGE: By submitting a photo, the entrant agrees to allow Wholesale Landscapes permission to use the image for the purposes of promoting Wholesale Landscapes products, now and into the future, at no cost to Wholesale Landscapes. The entrant also agrees to allow Wholesale Landscapes to use the photo for printed collateral, online, in store and across other marketing mediums

    10.    PHOTO TALENT: By submitting the photo, the entrant declares that they have the permission of all individual(s) captured in photo(s) to share and publish their image.

    11.    PHOTO COPYRIGHT: In submitting a photo for entry, the entrant declares that they have taken the photo and own and have sole and complete intellectual property rights to the photo. 

    12.    ENTRY FORMAT: Acceptable entries will be photo files from either digital cameras or smart phone cameras or electronic scans. No images supplied in hard copy will be accepted.

    13.    ACKNOWLEDGEMENTS: Entries may not be acknowledged or returned. Participants have the obligation to ensure entries are received on time. Wholesale Landscapes can choose to keep or remove images from the post on completion of the competition should they wish to do so.     14.    PERSONAL INFORMATION: The collection, use and disclosure of personal information provided in connection with this competition is governed by the Privacy Laws of New Zealand.
